Abstract:

By using the expression “the limits determined by the law”, the legislator has made legitimate the possibility of limiting the property rightand the exercise of this right and also, he established the social meaning and the function of property. This right is considered to be not only a right, but also a social obligation of the owner.

The juridical substance of this expression emphasizes all the legal limits predicted, installed by the law, decided by the law caourts, established by internal or external conventions or by an act or juridical fact in conformity with the nature of the property right.

In a narrow sense, it expresses the normal exercise of the property right. That means its internal and external limits, established by the law concernig the object and attributes of this right. These limits have to be regarded as a juridical modality of limiting the power that the owners of the right of property exercise in relation with any other person or with society itself.
