Abstract:

This article is practically a historical and a juridical view regarding the penal treatment of war criminals.

It presents the reasons why the Romanian legislation was changed after the Second World War, and why there were so many Soviet influences starting with the year 1944. These influences can be easily seen in the way that the so-called war criminals were punished, even if Romania was not a state that declared war but one that was attacked.

The article presents the ways that the Soviets used to impose themselves in our legal system and in our political and social lives.

It presents the penal procedures that were applied to those who were investigated as war criminals, starting with the offences, the authorities that were forced to apply the penal laws and the way these crimes should have been investigated.

After the Second World, Romania was left alone, to struggle with the Soviet forces, that, without being armed forces, were considerably dangerous. Even if these alien forces tried to impose a certain amount of laws, the Romanian government kept its position regarding the way that war criminals were to be defined, found and punished.

And so, presenting the most important laws that tried to regulate this problem, this article is, in fact, a résumé of a very delicate period of time in our history, and, most of all, a period that has had important consequences.
