Abstract:

The building up of an United Europe involves, among other things, the creating of an European judicial space for all the citizens of the European Union.

A first attempt in this respect is the Corpus Juris, whose aim is to ensure penal protection to the financial interests of the European Union and which includes 35 articles making up two sections, one dedicated to criminal law and the other to criminal procedure.

The first section includes regulations regarding the incrimination of corrupt activities and the fraudulent tampering with the community budget, authority abuse, embezzlement, money laundry and the association with the intent of committing crime.

The second section defines the penal responsibility of physical and juridical persons, as well as the Statute of the European Public Ministry.

Until the present, the decisions of the Corpus Juris have not been adopted by the organisms designated by the European Union; nevertheless, the member states have issued internal norms defining the penal responsability for actions attempting to the financial interests of the European Communities.

In the case of Romania, such a regulation was included by Law no. 78/2000, modified by Law no. 161/2003 and in the new Criminal Code (Title X, Chapter IV).
