Abstract:

The present article is proposing a comparative presentation of the internal legal disposals with the international ones in the matter of the extinctive prescription with respect to the international sale-purchase contract for wares.

Consisely analysing the issue of the internal law sources, as well as the transposition into practice of the constitutional disposals regarding the ratification of adhesion to the international conventions of our country, the author draws attention towards the particular case of the Protocol concluded in Vienna in 1980 regarding the extinctive prescription in the matter of the international sale of wares, which became Law nº 24/1992.

Having in view the special disposals of Law nº 24/1992 regarding the terms in the international trade law, it is analysed and ascertained the preeminence of the international settlement towards the internal dispossals of common law, regarding the prescription of the right to bring an action and the conditions and the terms within which it operates for the international trade relations.
