Abstract:

The European Convention on the Law Applicable to Contractual Obligations, signed in Rome, on June 19, 1980, in force since Aprilie 1st, 1991, has a considerable influence over the Law No. 105/1992 that regulates the conflicts of laws in Romania.

The Romanian legislator didn’t integrate, automatically, the provision of this convention. He had examined its provisions critically, he had evaluated them, before he introduced the most valuable rules of conflict in the act mentioned above. The Romanian legislator’s careful analysis improved the content of some rules established in the treaty and modified others.
