   Activitatea de cercetare din Universitatea “Mihail Kogalniceanu” se desfasoara in cadrul catedrelor si colectivelor, in cadrul Centrului Francofon de Drept Constitutional, a Cercurilor stiintifice studentesti. Valorificarea cercetarii se realizeaza prin Conferinta internationala a UMK, Sesiunea Stiintifica anuala a UMK, prin Masa rotunda internationala a Centrului Francofon de Drept Constitutional. De asemenea, in luna decembrie a fiecarui an, odata cu Zilele Universitatii “Mihail Kogalniceanu”, se organizeaza Sesiunea stiintifica studenteasca, iar in luna aprilie, Concursul studentesc de procese simulate.

Publicatiile editate de UMK, prin Editura Cugetarea, sunt Volumul Mesei rotunde internationale si Buletinul Stiintific al UMK, publicatie cotata de CNCSIS cu indicativul B+ si indexata in baze de date internationale.

THE CIRCLE OF CRIMINAL LAW

Program of activity


I. Objective:

a) The study and pragmatic understanding of concepts, principles and rules governing the institutions of civil law, as regulated by the Romanian civil code in force and by the new civil code.
b) Formation and development of students’ independent thinking and of their ability to learn creatively and practically.


II. The following activities will be carried out:

a.) Theoretical doctrine-based presentation of the legislation and jurisprudence of the institutions subject to debates;
b.) The practical and applicative presentation, consisting of opinions, theses, controversies, graphic representations, a set of questions and exercises, the presentation of sets of questions followed by cases adapted to the theme as well as the presentation of papers, either within the circle or during the students’ yearly session.


III. Themes for debates:

1st semester

1. The warranty of the property right in the system of Romanian law
2. The legal regime of goods from the cultural national patrimony

3. Commutative and property transfer contracts  
4. Legal limitations of the private property right

5. Random contracts
6. Gaining the property right in case of foreign stateless citizens
7. Expropriation for a public utility cause – exception from the absolute and  inalienable character of the property right

2nd semester

1. Judicial theory and practice regarding contractual civil liability
2 2. Tortuous civil liability for one’s own deed
3 3. Judicial theory and practice regarding the effects of obligations

4. Liberalitaties as species of legal acts  
5. The limits of the right to dispose of the inherited goods by means of legal acts between the survivors

6. Jurisprudence of the High Court of Cassation and Justice regarding the acquisition of the property right by usucaption  
7. The legal regime of expropriate buildings in the context of the constitutional dispositions, the dispositions of the European Convention of Human Rights and of the normative acts of reparatory character


IV. Students will perform their activities under the guidance of the specialized professors and of the coordinator of the circle.


V. Each session will be coordinated by one or two students


VI. The graphic of activities will be determined in agreement with the propositions formulated by the students and will be communicated at the beginning of each semester of the academic year


VII. Each student has the opportunity to make a paper presentation within the circle or in the students’ yearly session.
